The defendant Borg Warner hired and trained the guards. We alleged, successfully, that defendant Borg Warner acted under color of state law for all purposes relative to this litigation. As result, we achieved cash settlements to over a dozen homeless persons, totaling in the hundreds of thousands of dollars, and achieved a positive change in the way the homeless were treated in the shelters. Our complaint sought damages for violations of plaintiffs' constitutional civil rights pursuant to 42 U.S.C. §1983, and sought declaratory and injunctive relief and monetary damages for plaintiffs because their rights secured by the First, Fourth and Fourteenth Amendments to the United States Constitution and under common law of the State of New York
